Pay Period Frequency
Florida state law does not impose a mandatory pay frequency (unlike states requiring bi-weekly checks). Employers can pay weekly, bi-weekly, semi-monthly, or monthly as agreed upon.
Overtime Calculations
Florida does not have a state overtime statute. All overtime calculations default to federal FLSA rules: 1.5ร base hourly rate for hours over 40 in a workweek.
Deductions & Uniforms
Employers cannot make payroll deductions for damaged merchandise, cash register shortages, or mandatory uniforms if doing so reduces your effective hourly rate below the Florida minimum wage ($14.00/hr in 2025).
Final Paycheck Rights
Florida state law does not specify a strict deadline for final paychecks. Employers must pay accrued final wages on or before the next regular scheduled payday following termination.
